Terms of Service

These Terms of Service ("Terms") are the agreement between you ("you", "User") and Mubert ("Mubert", "we", "us", "our"). They explain how you may use the Mubert website, applications, APIs, AI music tools, uploads, generated outputs, subscriptions, and credit packs (collectively, the "Service"). Please read them before creating, uploading, downloading, or publishing content with Mubert.

1. Acceptance of Terms

By accessing, browsing, or otherwise using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, do not access or use the Service.

These Terms are effective as of 2026-04-30. We may update them from time to time as described in Section 17. Your continued use of the Service after an update constitutes your acceptance of the revised Terms.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

2. Description of Service

Mubert is an AI-powered music creation platform for creators who need usable audio and video assets quickly. The Service provides a suite of generative and editing tools, which currently include:

  • AI Music Generator - text-to-music generation based on prompts, genres, moods, or scenes you provide.
  • AI Music Video Generator - generation of visual content paired with music for social, promotional, or personal projects.
  • AI Cover - voice transformation applied to audio you upload, producing a new vocal rendition of the source track.
  • AI Music Remixer - remixing uploaded audio into new arrangements, tempos, or variations.
  • Add Vocals to Music - generation of vocal layers over instrumental tracks, optionally guided by lyrics you supply.
  • AI Instrumental Generator - generation of backing tracks, beats, underscore, and instrumental music without vocals.
  • AI Music Extender - extension of short audio clips into longer pieces that follow the style and structure of the input.
  • Vocal Remover - separation of vocal and instrumental stems for karaoke, remixing, sampling, or editing workflows.

2.1 Plans and Availability

The Service is offered through free access, paid subscriptions, and credit packs. Features, credits, output length, file formats, storage duration, concurrency, support level, and commercial-use rights vary by plan and are described on the pricing page at the time you subscribe or purchase credits.

2.2 Changes to the Service

We are continuously developing the Service. We may add, modify, deprecate, or discontinue features, tools, or model versions at any time, including during your subscription period. Where a change materially reduces the core functionality of a paid plan, we will use commercially reasonable efforts to provide notice and, where appropriate, a comparable replacement.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

You must have the legal capacity to enter into a binding contract and must not be barred from using the Service under the laws of any applicable jurisdiction. You are responsible for ensuring that your use of the Service is lawful in the place from which you access it.

We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us so that we can remove the information and close the associated account.

4. User Accounts

4.1 Registration

Most features require an account. You may create an account using supported OAuth providers (such as Google) or other sign-in methods we offer. You must provide accurate information and keep it current.

4.2 Account Security

You are responsible for safeguarding your credentials and for all activity that occurs under your account. Do not share your account with others. Notify us promptly if you suspect unauthorized access or any other breach of security.

4.3 One Account Per User

You may not create multiple accounts to circumvent plan limits, free-trial quotas, or other restrictions. We may suspend or terminate accounts that we reasonably believe are duplicates or are being used to abuse free-tier allowances.

4.4 Suspension and Termination

We may suspend, limit, or terminate your account at any time if we believe you have violated these Terms, if required by law, or if your use of the Service poses a risk to Mubert, other users, or third parties. You may close your account at any time through your account settings or by contacting us.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:

  • Generate, upload, or distribute content that is unlawful, defamatory, obscene, sexually explicit involving minors, harassing, threatening, or that incites violence or hatred.
  • Infringe any copyright, trademark, trade secret, publicity, privacy, or other intellectual property or proprietary right.
  • Attempt to reverse-engineer, decompile, or otherwise derive the source code, model weights, or training data of the Service, except to the extent expressly permitted by law.
  • Interfere with, disrupt, or compromise the integrity or performance of the Service or its infrastructure.
  • Circumvent, disable, or otherwise attempt to bypass rate limits, usage quotas, authentication mechanisms, or other technical restrictions.
  • Use bots, scrapers, or other automated means to access the Service beyond what is allowed by a published API and your plan.
  • Use the Service to build, train, or benchmark a competing AI model or dataset.

We reserve the right to investigate suspected violations and to remove content or restrict accounts that we believe violate this Section.

5.1 Rate Limits and Fair Use

Each plan has published generation limits, concurrency limits, and daily or monthly caps. Even on plans marketed as "unlimited," fair-use thresholds apply to protect service stability for all users. If your usage materially exceeds typical patterns for your plan, we may contact you, throttle your usage, or require an upgrade.

5.2 Content about Real People

You must not use the Service to generate content that impersonates a real person's voice, likeness, or performance without that person's verifiable consent, or that violates rights of publicity, privacy, or personality in the subject's jurisdiction. Public figures are not an exception to this rule.

6. User-Uploaded Content

Some features require you to upload audio, images, text, or other material ("User Content"). You retain ownership of your User Content.

6.1 Your Warranties

You represent and warrant that:

  • You own your User Content or have obtained all rights, licenses, consents, and permissions necessary to upload it and to have it processed by the Service.
  • Your User Content does not infringe or violate any third-party right, including copyright, trademark, publicity, privacy, or contractual rights.
  • You will not upload copyrighted songs, recordings, vocal samples, or other material that you do not own or are not authorized to use. This applies in particular to AI Cover, AI Music Remixer, Add Vocals to Music, AI Music Extender, and Vocal Remover.

6.2 License to Mubert

Solely to provide and operate the Service, you grant Mubert a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, create derivative works of (such as generated outputs), and otherwise process your User Content. This license exists only to enable us to deliver the Service to you, to maintain system integrity, to prevent abuse, and to comply with law. It terminates when you delete the User Content, subject to reasonable backup retention and legal-hold requirements.

6.3 Removal

We may remove or refuse to process User Content that we reasonably believe violates these Terms, infringes third-party rights, or is otherwise objectionable.

6.4 Storage and Retention

We may retain User Content and Outputs for as long as your account is active and for a reasonable period thereafter for backup, audit, dispute-resolution, and legal-compliance purposes. You are responsible for maintaining your own copies of any User Content or Outputs you wish to preserve independently of the Service.

6.5 Feedback

If you submit suggestions, ideas, or feedback about the Service ("Feedback"), you grant Mubert a perpetual, irrevocable, worldwide, royalty-free license to use the Feedback for any purpose without obligation to you.

7. AI-Generated Content Ownership

7.1 Outputs on Paid Plans

Subject to your compliance with these Terms and full payment of applicable fees, Mubert grants you a worldwide, perpetual, commercial-use license to the audio, video, and other output generated by the Service under your active paid plan ("Outputs"). You may use your Outputs in commercial projects, including monetized videos, streaming releases, advertisements, games, and client work, within the scope of your plan.

7.2 Outputs on the Free Tier

Outputs generated on the free tier are licensed for personal, non-commercial use only. You may listen to and share them for non-commercial purposes but may not sell, license, monetize, or use them in commercial projects. To unlock commercial rights, upgrade to a paid plan.

7.3 Mubert's Retained Rights

Mubert retains all right, title, and interest in and to the Service, its underlying AI models, model weights, training data, datasets, software, documentation, brand, logos, and trade dress. No license to any of the foregoing is granted to you except as expressly set forth in these Terms.

7.4 No Guarantee of Uniqueness

Because generative models produce outputs from statistical patterns, similar prompts or inputs may yield similar or overlapping Outputs across different users. Mubert does not guarantee that any Output is unique, original, or free of resemblance to other Outputs, existing works, or third-party material. You are responsible for evaluating the suitability of an Output before commercial use.

7.5 Your Responsibility for Outputs

You are responsible for how you use Outputs. You must comply with all applicable laws, third-party rights, and platform rules (for example, those of streaming services and social platforms) when distributing or monetizing Outputs.

7.6 Attribution

Attribution to Mubert is appreciated but not required for Outputs generated under a paid plan, unless your specific plan states otherwise. You may not falsely claim that Mubert endorses you, your project, or your Outputs.

7.7 Downgrade and Plan Changes

If you downgrade from a paid plan to the free tier or let your subscription lapse, Outputs generated while the paid plan was active retain their commercial-use license, provided you continue to comply with these Terms. Outputs generated after the downgrade are subject to the license applicable to your then-current plan.

8. Subscriptions and Payments

8.1 Plans and Fees

Paid features are offered through subscription plans and one-time credit packs. Fees, included credits, generation quotas, storage rules, and commercial-use scope are shown on the pricing page and at checkout.

8.2 Payment Processing

Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms. Mubert does not receive or store your full payment card details; we receive only tokenized references and limited metadata necessary to manage your subscription.

8.3 Auto-Renewal

Subscriptions renew automatically at the end of each billing cycle (monthly or annual, as selected) at the then-current price, using your stored payment method, until you cancel. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing cycle; you retain access to paid features until then.

8.4 Price Changes

We may change subscription fees. For existing subscribers, we will provide reasonable advance notice before a price change takes effect at the next renewal. If you do not agree to the new price, you may cancel before it applies.

8.5 Taxes

Fees are exclusive of applicable taxes, duties, and similar governmental charges, which you are responsible for paying.

8.6 Failed Payments

If a scheduled charge fails, we may retry the payment, suspend paid features, or downgrade your account until payment is received. Generation credits or quotas associated with an unpaid billing period may be withheld until the balance is settled.

8.7 Promotional Offers

From time to time we may offer promotional prices, trials, or bundled credits. These offers are subject to additional terms presented at the time of the offer and may be limited to new users, specific plans, or specific regions. Promotional pricing automatically reverts to the then-current standard price at the end of the promotional period unless you cancel.

9. Refunds

Refunds, where available, are governed by our Refund Policy. Please review it before subscribing. Except as expressly stated in the Refund Policy or required by applicable law, all fees are non-refundable.

10. Prohibited Uses

In addition to the restrictions in Section 5, you specifically agree not to use the Service to:

  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
  • Engage in fraud, phishing, money laundering, or any other illegal or deceptive activity.
  • Train, evaluate, fine-tune, or benchmark a competing AI system, whether directly or by contracting with a third party.
  • Scrape, harvest, or otherwise extract Outputs, prompts, metadata, model behavior, or other data in bulk.
  • Generate content designed to defame, harass, or stalk a specific individual.
  • Create synthetic media intended to deceive (for example, non-consensual deepfakes of real people's voices).
  • Resell, sublicense, or redistribute access to the Service without our prior written consent.
  • Use the Service in any manner that violates export controls, sanctions, or other trade-compliance laws.
  • Attempt to extract, probe, or map internal system prompts, safety filters, or model parameters.
  • Use the Service to generate spam, malware, or content designed to distribute malicious code.

10.1 Enforcement

We may take any action we deem appropriate to enforce this Section, including warning you, throttling usage, removing content, suspending or terminating the account, refusing refunds for the terminated period, and cooperating with law enforcement. Enforcement actions do not constitute a waiver of any other rights or remedies available to us.

Mubert respects intellectual property rights and responds to valid notices of alleged infringement under the Digital Millennium Copyright Act ("DMCA") and similar laws.

If you believe that content made available through the Service infringes a copyright you own or control, please send a notice that includes:

  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the allegedly infringing material and information sufficient for us to locate it (for example, a URL).
  4. Your contact information (name, address, telephone number, email).
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Upon receipt of a valid notice, we will act expeditiously to investigate and, where appropriate, remove or disable access to the material. Repeat infringers will have their accounts terminated. If you believe material was removed in error, you may submit a counter-notice with the elements required by 17 U.S.C. Section 512(g).

12. Disclaimers and Warranty

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MUBERT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.

Without limiting the foregoing:

  • We do not warrant that the Service will be uninterrupted, secure, or error-free.
  • AI-generated Outputs may be unexpected, inaccurate, offensive, or unsuitable for your purpose. You are responsible for reviewing each Output before use.
  • We do not warrant that Outputs are free from resemblance to third-party works or that their use will not give rise to claims by third parties.
  • We do not provide legal advice regarding the clearance, registration, or exploitation of Outputs.

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law.

12.1 Third-Party Services

The Service may integrate with or link to third-party services, including payment processors, OAuth providers, and content platforms. We do not control these services and are not responsible for their availability, accuracy, content, or practices. Your use of third-party services is governed by their own terms and privacy policies.

12.2 Beta Features

From time to time we may offer experimental, beta, or preview features. These are provided on an "as-is" basis, may be unstable or produce unexpected results, and may be modified or withdrawn at any time. Beta features may be excluded from service-level commitments even for paid plans.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MUBERT, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF MUBERT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MUBERT'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO MUBERT FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

The limitations in this Section apply to the fullest extent permitted by law, even if a limited remedy fails of its essential purpose.

14. Indemnification

You agree to indemnify, defend, and hold harmless Mubert, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your User Content, including any claim that your User Content infringes a third party's rights.
  • Your use of the Service or any Outputs, including any commercial exploitation of Outputs.
  • Your breach of these Terms or violation of any applicable law.
  • Your violation of any third-party right.
  • Your misrepresentations regarding ownership of, or rights in, material you upload for processing by AI Cover, AI Music Remixer, Add Vocals to Music, AI Music Extender, or Vocal Remover.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with our defense. You may not settle any matter subject to this Section without our prior written consent, which will not be unreasonably withheld.

15. Termination

Either party may terminate this agreement at any time. You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or for prolonged inactivity.

Upon termination:

  • Your right to access and use the Service ends immediately.
  • Your commercial-use license to Outputs generated while you held a valid paid plan survives, subject to your continued compliance with these Terms.
  • Provisions that by their nature should survive termination (including Sections 6.1, 7, 10, 12, 13, 14, 16, and 18) will survive.
  • Any outstanding fees you owe become immediately due and payable.

15.1 Effect on Stored Content

After termination, we may delete your User Content and any Outputs associated with your account after a reasonable period. Export options, if any, are described in your account settings. We are not obligated to retain or return your User Content or Outputs after termination except as required by law.

16. Governing Law

These Terms are governed by the laws of the jurisdiction in which Mubert is organized, without regard to its conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the courts located in that jurisdiction for the resolution of any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

17. Changes to Terms

We may revise these Terms from time to time. When we do, we will update the "updated_at" date above and, for material changes, provide additional notice (for example, by email or an in-product notification). Unless otherwise stated, changes take effect when posted. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

17.1 Miscellaneous

These Terms, together with the Privacy Policy, Refund Policy, and any plan-specific terms presented at checkout, constitute the entire agreement between you and Mubert regarding the Service and supersede any prior agreements on the same subject matter. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a right is not a waiver of that right. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets. There are no third-party beneficiaries.
